Introduction:

Welcome to the MET Academy (Maritime EdTech Academy). These terms and conditions govern the usage of our services, including both online and offline coaching programmes for the IMU CET (Indian Maritime University Common Entrance Test) exam and by enrolling in our courses, you are hereby agreeing to comply with these terms and conditions.

(a). At first, please carefully read the following terms and conditions ("Terms of Use") of the services made accessible , available on the website https://www.metacademy.co.in or the corresponding applications in Android and iOS, which may be combined and referred to for the convenience as the "Sources" " Your ", " You," or " User " shall signify any natural or legal person who browses the Platform or has decided to become a subscriber to the services on the Sources by providing while registering through an application / subscription form as a subscribed user.

(b). The terms defined herein as "We," " Us ," and "Our" refer to Maritime Ed Tech Academy (MET Academy).

(c). These Terms of Use apply when you use the Sources, and we may change these Terms of Use from time to time, and we will make every effort to advise and inform you of such changes as and when they are made. Further, you are required to read our terms and conditions before using the Sources or Services, as applicable, in this programme.

(d). You must be aware that the Maritime EdTech Academy does not provide a guarantee of success or employment /placement or any other career assurance for any student in the IMU CET test prior to enrolling in any courses or using any services in this programme , it is crucial to thoroughly examine and evaluate all terms and conditions.

(e). It is necessary to provide your e-mail address and/or phone number during registration. You will be contacted by us, and we may contact you by phone calls, SMS alerts, and/or e-mails about any subscription or other services under this programme.

Enrolment and Fees

(a). Eligibility: Enrolment is open to all eligible, aspiring students with a qualified, completed degree without any academic disqualification for further studies

(b). Course Fees: All fees as prescribed in the catalogue must be paid in full prior to the commencement of the course, and the fees paid in full will not be refunded under any circumstances.

(c). Payment methods: Payments can be made through our websites, applications, bank transfers, or other methods specified by the catalogue of MET Academy.

(d). Course duration: The duration of the course and the schedules of the offline and online classes, including the changes if any, will be notified, communicated to the subscriber appropriately through electronic means. (email and/or SMS).

Course Delivery

(a) Online Courses: Online coaching sessions will be conducted via our designated platform, and it is the responsibility of the students to make sure they must have the uninterrupted internet access and devices needed to participate.

(b) Offline Courses: Offline coaching will also take place at physical locations, as specified during enrolment or during the course's progress.

(c) Course Content: All course materials for the programme provided are for the exclusive use of the enrolled student exclusively and must not be shared, copied, or redistributed in any form.

(d) Access: Online course access is granted only to the enrolled student and cannot be transferred or shared under any circumstances.

(e) Minimum prerequisites for Mobile phone application access:

(i) You must be aware that it is your responsibility to verify if the device you intend to use to access the subscription meets the minimum specification requirement for the subscription package that you are purchasing under this programme, and you must recognise and understand that MET Academy cannot be held responsible, liable, or accountable for any technical issues, including but not limited to the smooth presentation of audiovisual material with any systems, computers, or gadgets available with you that you come across after the start of the subscription package.

(ii) Minimum device requirements:

(a) Android 4.4 devices and above.

(b) iOS 9.0: Not modified to allow unauthorised software

Cancellation and Refund Policy

(a) Cancellation by Student: If a student wishes to cancel their enrolment, they must notify MET Academy in writing through email in advance; however, once fees are paid, they are non-refundable.

(b) Cancellation by MET Academy: In the event that MET Academy cancels a course, students will be offered an alternative course.

(c) Course Changes: MET Academy reserves the right to change course schedules, instructors, and content. Students will be informed about any significant changes or updates in advance, if any.

(d) Account suspension or cancellation due to suspected or actual illegal activity:

(i) In the event any allegation of improper or unlawful conduct is identified , we reserve the exclusive right to promptly suspend your account immediately and if necessary, prohibit any future access by you to the Sources.

(ii) MET Academy has the rightful authority to terminate any subscription that it suspects has been compromised or is currently being hacked, Utilised deceitfully, at its own discretion, without any financial responsibility to you.

(iii) The user's account will be blocked for many reasons, including but not limited to:

  • a.If deemed suspicious (High/Suspicious Activity)
  • b.Usage of rooted or jailbroken devices, emulators, ChromeCast, and Android TV is prohibited.
  • c.The Amazon Fire TV is a smart TV that can also function as a DVD player and is compatible with virtual machines. Screen casting, screen recording, screen mirroring, and downloading videos are all methods of capturing and saving video content from a screen.

Attendance and Participation

(a) Online Attendance: Students are expected to attend all scheduled online sessions as specified, and the MET Academy is not responsible for any missed sessions or unattended sessions due to technical issues on the students end.

(b) Offline Attendance: Regular attendance is mandatory for offline courses, and students must adhere to the schedule of the classes as provided at the time of enrolment.

(c) Participation: Active participation in classes, assignments, and tests are essential for success in the IMU CET exam.

Code of Conduct

(a) The student shall comply with the terms and conditions set forth herein in his collection of course materials , receipts, transmission, storage, disposal, use, and disclosure of confidential information and be responsible for the unauthorised collection, receipt, transmission, access, storage, disposal, use, and disclosure of confidential information under his control or in his possession by all authorised third parties.

(b) Respectful Behaviour: Students are expected to maintain a respectful and professional demeanour during both online and offline sessions.

(c) Prohibited Conduct: Any form of harassment, plagiarism, or disruptive behaviour will result in disciplinary action, including possible expulsion from the course without refund of the fee.

(d) Property: Students must treat MET Academy's physical and intellectual property with care and respect.

Intellectual Property

(a). The intellectual property rights existing now or during the course period in its presentation and training materials, computer programs, documentation, and other materials, as well as in any method, explanation, drawing, design, or concept to the extent solely conceived or developed by MET Academy, shall be the absolute property of MET Academy . Except as stated herein, Students will not have any rights to any materials or methodologies that are proprietary, and proprietary materials or methodologies are not part of the deliverables. In case of any violation of the patents, copyright, trademark, design, or any other intellectual property right(s) of MET Academy by the third party or parties in connection with conducting the course, the subscriber will defend such claims and keep the MET Academy fully indemnified at all times against any loss or consequence. This clause shall survive the termination of the course.

(b). Copyright, Trademark, and Restriction:

(i). The MET Academy is the owner of all trademarks and logos. The unapproved replication, altering, utilising, or publishing of these marks in any way is not permitted.

(ii). The intellectual property of the MET Academy and/or its licensors remains the property of the resources and the instructional session. No study guide, course, or component thereof may be copied, kept in a retrieval system, or sent in any way or by any means without the prior written permission of MET Academy.

(c). Other terms and conditions for subscribing to and accessing online content:

(i). Unless stated otherwise in the subscription package description provided on the applications platform and our website, no other supplementary resources and/or video lessons will be provided by MET Academy.

(ii). It is to be noted that after receiving a confirmation email from MET Academy, you will be informed when you (solely as an individual Subscribed Users) receive access to the services for which you have paid for a certain duration provided to you; however, MET Academy has the complete authority to terminate or suspend your access as per these agreed Terms of Use.

(iii). A subscription received is personal property to You and You shall not transfer or share your right to the subscription in favour of any third party or other sers. The subscription that you obtain is only for your own use, and you are not permitted to transfer or distribute your rights to the resources, resell the subscription, or provide access to the subscription to any individual for any purpose under any circumstances.

(iv). Confidential Information: Confidential and/or proprietary information shall mean and include any information disclosed by MET Academy to Students either directly or indirectly, inwriting or orally (including, without limitation, documents, prototypes, samples, media, documentation,discs, and code) Confidential information shall include, without limitation, any materials, information, material, or data relating to the programme of the MET Academy and analysis, compilations, studies, summaries, extracts, or other documentation prepared by the MET Academy. Confidential information may also include information disclosed to the Students by third parties on behalf of the MET Academy, and the Student shall refrain from disclosing, reproducing, summarising, and/or distributing Confidential Information and confidential materials of the MET Academy

(d). Prohibition of the MET Academy Sources:

The following are completely prohibited or avoided:

  • Recording application material with a camera, phone, screen recording, or any other device or technology
  • Sharing MET Academy screenshots on social media or any other network is prohibited.
  • Prohibiting the sharing of MET Academy contents with anybody.
  • Engaging in the mistreatment or exploitation of MET Academy and its faculties, including the attempt to market and distribute MET Academy and its accompanying content via internet platforms.

(e). Usage:

(i). Students of this programme shall use the materials for personal educational purposes only, and the reproduction, distribution, or commercial use of the materials is strictly prohibited.

(ii). The subscription that you have obtained is only for your own use, and you are not permitted to transfer or distribute your rights to the resources, resell the subscription, or provide access to the subscription to any individual for any purpose under any circumstances.

Limitation of Liability

(a). Content Accuracy: MET Academy strives to provide accurate and up-to-date information in all courses, however, we do not guarantee the accuracy or completeness of the content, and the Students are encouraged to verify information independently before relying on it for any purpose. Additionally, MET Academy is not liable for any errors or omissions in the resource materials.

(b). Technical Issues: MET Academy is not liable for any technical issues that may disrupt access to online courses.

(c). Technical assistance and availability of the sources:

  • (i). MET Academy does not guarantee that the subscription will operate without interruption or error.
  • (ii). With regard to your membership, MET Academy is under no obligation to provide You with any technical assistance other than the particular assistance that is included in the subscription package that you have chosen.
  • (iii). You understand and agree that MET Academy is not liable for any delays or interferences with your subscription brought on by this suspension or due to any third party issues related to the subscribed packages.
  • (iv). Health and Safety: MET Academy is not responsible for any injuries or accidents that occur during offline classes, and it is the responsibility of students to ensure their own health and safety at all times while attending classes or engaging in any course related physical activities. It is also recommended that students follow all safety guidelines and instructions provided by instructors to prevent any potential risks.

Privacy Policy

(a). Data Collection: By enrolling in MET Academy, you agree to our collection and use of your personal information as outlined in our Privacy Policy.

(b). Confidentiality: All students' information will be kept confidential and will not be shared with third parties without the students consent, except as required by law.

(c). Services Disclaimer:

(i). You recognise and consent that the ideas and recommendations offered by us on the Sources are only suggestions, and you may choose whether or not to comply with them.

(ii). MET Academy provides a range of services to only assist you in preparing for the Merchant Navy entry examinations, complemented by personalised help and assistance.

(d). Disclaimer on Resources:

(i). The term "resources" in these Terms of Use includes videos, question banks, test series, and supplementary educational materials related to certain subjects, as well as physical copies of such materials that are available for access or periodically accessible electronic content. Upon fulfilling all the requirements outlined in these Terms of Use and becoming a subscribed user, you will have access to these study resources. The Services and any supporting resources are provided only on an "AS IS" basis, and MET Academy explicitly declares that the resources and the Services are not meant to serve as a replacement for the expert advice of a maritime professional on any conditions.

(ii). Other Parties: On our website or the MET Academy app, we could utilise or integrate the platform of a different third party. We may also use third-party sites to provide ourselves with services. In such a case, you are bound by the privacy statement, terms and conditions, and any other relevant rules of such a third party. Your further consent to and thus grant MET Academy permission to share Your data and private information with such third parties as required in order for MET Academy to provide You with the Services.

Amendments

MET Academy reserves all rights to amend these terms and conditions at any time, and the Students will be notified and updated of any significant changes as and when made during the course period .

Governing Law

These terms and conditions are governed by and construed in accordance with the prevailing, applicable laws of India, and any disputes will be subject to the exclusive jurisdiction of the courts in Chennai.
